CALIFORNIA PROPOSITION 65 STATEMENT
At Rosemary Chocolat, we take food safety and compliance with legislative and regulatory standards seriously. Approved raw-material suppliers must demonstrate that they monitor for certain contaminants in the products they supply to us or otherwise certify the raw materials as meeting the requirements of California’s Safe Drinking Water and Toxic Enforcement Act of 1986 (“Proposition 65”).
Almost all cocoa products contain trace amounts of minerals and elements, including cadmium (a heavy metal). The industry acknowledges that these elements enter cocoa at the farm level through natural soil absorption. Consequently, levels can vary between farms. Proposition 65 provides an exemption for chemicals considered “naturally occurring” in food, such as these heavy metals.
We consider our chocolate and cocoa products to be in compliance with current Prop 65 regulations. We will continue to monitor regulatory updates and adjust our policies as necessary to ensure ongoing compliance with any new Proposition 65 standards.

The State of California leads the United States in food-safety legislation. Proposition 65 sets strict guidelines for foods sold in California, covering aspects not addressed by other jurisdictions. Below is important information regarding heavy metals in food.
CHOCOLATE AND HEAVY METALS
Naturally occurring heavy metals like cadmium and lead are present in all plants grown in healthy soil, as these elements exist in the Earth’s crust. Therefore, all-natural agricultural products contain some level of heavy metals. While the human body has efficient detoxification systems, excessive intake can pose health risks. Cocoa beans naturally contain trace lead and cadmium, but cacao trees require only minimal uptake of these elements for growth.
Cacao trees absorb essential nutrients—such as magnesium, copper, and iron—from the soil, contributing to the recognition of cocoa beans as a superfood.
